Terms and Conditions for Uploads of Photographs on iVillage.co.uk
The terms set forth below apply to the submission by you to iVillage of one or more photographs by uploading such photographs to an iVillage website.  You should read and understand these terms before submitting any photographs.  You may not submit any photographs to iVillage if you do not agree with these terms.  We note that these terms are in addition to the terms set forth in the iVillage Network Terms of Service. With respect to each photograph that you submit, you agree to the following: 
1.  You are over the age of 12.
2.  You have reviewed and agree to comply with these terms and the iVillage Network Terms of Service (unless you are aged 13-17 years old, in which case, your parent or guardian has reviewed and agrees to these Terms of Service on your behalf).
3.  You have the rights necessary to authorise iVillage and its designees to, and you hereby grant such authorisation to iVillage and its designees to: (a) copy, distribute, edit, adapt, publicly display, publicly perform and otherwise use the photograph, and to create derivative works of the photograph and incorporate the photograph into other works or into products or services, in any format or medium now known or later developed and through all media channels; (b) make any changes that iVillage deems necessary to the photograph, including, without limitation, editing the appearance of individuals in the photograph; (c) exercise all copyright, trademark and publicity rights with regard to the photograph; (d) use your name, likeness, photograph, and/or biographical information in connection with the photograph and any and all publicity and promotional activities with respect to the photograph; and (e) authorise others to exercise all of these rights.
4.  You represent and warrant that: (a) each individual depicted in the photograph is over the age of 12 or you have obtained the written consent of such individual's parent or guardian, and each such individual (or the parent or guardian of such individual, as applicable) has expressly consented to the photograph being submitted to iVillage and made publicly available on the Internet or through any other media channels after being submitted to iVillage; (b) the photograph has not been modified or altered in any manner so as to distort or misrepresent any individual or thing depicted in the photograph; (c) the photograph does not contain any personal information (such as a name, phone number or email address); and (d) the photograph does not contain any offensive, obscene, pornographic, unlawful, defamatory, libelous, threatening, harassing, or degrading material.
5.  iVillage reserves the right in its sole discretion to remove or not post any photograph, for any reason.
6.  Materials submitted to iVillage.co.uk will not be returned to the submitting party, and iVillage has no obligation to inform you of any decision to remove or not post such materials.
7.  You shall be solely responsible for any photograph or other material that you submit to iVillage and the consequences of your submitting such material to iVillage.  Accordingly, you hereby release iVillage and its related companies, parents, licensees, employees, contractors, designees, sponsors, business partners and assigns from any and all claims, demands or causes of action that you may have, or may in the future have, for libel, defamation, violations of the right of privacy or publicity, infringement of copyright or trademark, unfair competition, violations of moral rights or any other claims arising out of or relating to any use of the photograph or the rights granted under this agreement.
8.  Any dispute relating to any materials you submit to iVillage shall be governed by UK law.
9.  You agree that you have received good and valuable consideration in exchange for the rights granted by you hereunder in the photograph, including, but not limited to, the possibility that publicity or favorable exposure may arise from the use by iVillage or one of its partners or designees of the photograph.  You agree that you are not entitled to any further compensation for any use of the photograph by iVillage or its designees.
10.  If you would like to request that a photograph that you have submitted, or any photograph depicting you, be removed from our website, you may do so by sending a written request to support@ivillage.com identifying the precise location of the photograph on our website, your relationship to the photograph and the reason why you seek its removal.  iVillage shall determine whether to honor the request in its sole discretion.
