Part-time problem

by The Maternity Alliance

question
I used to work full-time before my maternity leave, but I have to go back to work part-time because I can’t find suitable childcare. Do I have the right to do this?

answer
You do not have an automatic right to return to work part-time, but your employer does have a duty to seriously consider your request. Also, because you have a good reason for asking to return to work on different hours your employer can only refuse your request if he has a good business reason for doing so. This is quite a complex area. You may find it helpful to get hold of a copy of our booklet ‘Your Rights to Child-Friendly Working Hours’, which sets out your rights and your employer’s responsibilities in more detail.
