I don't want to return to work. Will I have to repay my maternity pay?

answer

If you decide not to go back to work you should resign in the usual way, giving the notice period stated in your contract.

If you do not return to work, you will NOT have to repay any Statutory Maternity Pay (SMP) you have been paid, which is 90 per cent of your average weekly pay for 6 weeks and 33 weeks at £112.75. Your employer claims most of your SMP back from the government so it is never repayable by you in any circumstances. Anything over and above this SMP you only have to repay if your contract says so, or it was agreed in advance.

You will have accrued some holiday during maternity leave, you should be paid for this in your final payslip.
