Fixed-term contract and maternity leave

I am on a one-year, fixed-term contract that ends a week before my baby is due, what are my rights?

answer

You have the same maternity rights as employees on permanent contracts. You have the right to one year's maternity leave (as long as you remain in employment). If you have been employed by the same employer throughout your pregnancy you may also be entitled to Statutory Maternity Pay (SMP), depending on your earnings.

If your contract ends during your SMP period you are still entitled to receive your SMP for the full 39 weeks.

Not renewing a fixed term contract is a dismissal, and you must be given written reasons for the dismissal, e.g. the project you were working on has ended. The non-renewal must not be connected in any way to pregnancy or maternity leave.
