Resigning during Maternity Leave

I am due to go on Maternity Leave. How many weeks notice must I give and before I go? Do I need to inform my employer that I don't intend to return to work after the baby's born?

Before going on Maternity Leave you need to give your employer 28 days notice in writing, this should include the expected week of childbirth and the date when you will take maternity leave. Ask for Statutory Maternity Pay and, if your employer asks for it, enclose your maternity certificate.

You do not have to tell your employer that you will not return at the end of maternity leave and you could hand in your resignation notice during your maternity leave. Timing your resignation period to finish at the end of the leave would entitle you to the accrued annual leave pay which you would receive at the end of maternity leave. You remain an employee during maternity leave, unless you have resigned. For more information see Working Families Website
