Can I break my notice period?

question
I have been offered a new job. My contract with my current employer states I must give three months notice, but my new employer wants me to start in a month. What action may my present employer take if I give them just one months notice?

answer

Congratulations on the new job. The best course of action would be to try to amicably agree with your employer to waive the full notice period and terminate your employment after a month. In that case your employer will probably ask you to confirm in writing that you agree to the termination date in a month's time and to forfeiting two months of your three months' notice pay rights.
