Extending my notice period

by Work Rights Expert, Rachel Lewis

question
I've been in my current job for four months, but I have two months before my new job begins. My notice period is a month. If I gave them two months notice instead, could they ask me to leave after one month?

I'd like to be fair as I know one month won't be long enough to replace me, but as the main breadwinner I can't afford not to work.
Thanks
Sam

answer
Hi Sam,
Congrats on the new job!
Unfortunately, if you give them two months notice, they can say, OK, we only need one month, and let you go after that. Similarly, if you say to them, I'm giving you informal notice that I will be giving you formal notice in a month's time, since you've only been there a short period, they might terminate you on a month's notice with impunity.

So, I'd be tempted to stay quiet for a bit, unless you trust them enough to be generous with your notice period.
Good luck
Rachel
