Fixed-term contract and maternity leave

question
I am on a one-year, fixed-term contract that ends a week before my baby is due, what are my rights?

You have the same maternity rights as employees on permanent contracts. You have the right 1826 weeks ordinary maternity leave. If you have been employed by the same employer throughout your pregnancy you should also be entitled to a further 26 weeks additional maternity leave and Statutory Maternity Pay (SMP) (as long as you meet the other qualifying criteria).

If your contract ends during your SMP period you are still entitled to receive your SMP for the full 26 weeks.

If you are expecting your contract to be renewed then this renewal should not be affected by your pregnancy, childbirth or absence on maternity leave.

For more information on maternity rights for temporary and fixed term workers, please send £1 and an SAE and ask for our factsheet 'Temporary, casual and sessional workers - rights for parents'.
