From sick to sacked, what can I do?

by Work Rights Expert, Rachel Lewis

question
This morning I received my P45 with no accompanying letter. I have been off sick for approximately 10 months with reactive depression, and have been fighting an equal pay claim with the help of my union. I have attended all the meetings and had agreed to visit the Occupational Therapist, and no mention was made of finishing my employment at the last meeting. rebelmaz

answer
Yes, it sounds like you most definitely have a claim - this is appalling treatment by your employer. If there has been no warning about dismissal, then I cannot see how the decision can possibly be fair. Plus there may be victimisation arguments, given the equal pay claim. Have a word with your union, if they are already involved, and chat through how to play it. There may be some mileage in contacting the company with a request for written reasons for the dismissal, and an appeal.
