Three months notice? I want out now!

by Work Rights Expert, Rachel Lewis

question
I work for a well-known bank and have a contract that requires three months notice - I want to leave the company but only give 1 months notice. Can the bank force me to give the full three months, or if I leave after a month could they sue me?

answer
If your contract requires you to give three months notice and you only give one, there are some risks, but hopefully fairly remote ones.

You will technically be in breach of contract if you leave early. The company will not be able to issue you an injunction requiring you to work, but could potentially sue for any losses they incur such as getting in temporary staff to cover your work, although this is incredibly rare. They could however, reflect their dissatisfaction in any future reference they give you.

It might be best to try to agree an early departure date. If the bank doesn't play ball, you can then consider whether you want just to 'disappear' after the month.
